These terms and conditions (the "Terms and Conditions") govern the use of www.petalandpondflowers.com (the "Site"). This Site is owned and operated by Petal and Pond Lakeside Flower Company LLC. This Site is an ecommerce website. 
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times. 
 

Intellectual Property 
All content published and made available on our Site is the property of Petal and Pond Lakeside Flower Company LLC and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site. 

 
Age Restrictions 
The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age. 

 
Sale of Goods And Services 
These Terms and Conditions govern the sale of goods and services available on our Site. 

 
The following goods are available on our Site: 

Flowers, Floral Bouquets, and Floral Arrangements. 
 

The following services are available on our Site: 
Florist Services, event/wedding consultations, and funeral consultations. 

 

  • The services are to be paid for in full 30 days before scheduled event day. For events, weddings and funerals a payment plan between Petal and Pond Lakeside Flower Company, and client.  Can be arranged, all details will be discussed and set up during consultation.  

  • Consultation fees are to be paid at the time of appointment and not after. 

 
These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk. 
 
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund. 

 
Payments 
We accept the following payment methods on our Site:  

  • Credit Card 

  • Debit Card 

  • Venmo Payments 

 
When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge, the amount due to this payment instrument. 
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction. 

 
Shipping and Delivery 

 
When you purchase goods from our Site, the goods will be delivered through one of the following methods: 

  •   Delivery On Arrangements, Funeral Sprays, Bouquets, and other small items take 24-48 hours to deliver. 

  • Larger Items for weddings/events will be discussed at consultation. 
     

Delivery will take place as soon as reasonably possible depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and statutory holidays. 
You will be required to pay delivery charges in addition to the price for the goods you purchase 
You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information. 
 
Refunds 

Refunds for Goods 
All goods sold on our Site are non-refundable 
 

Refunds for Services 
Events and weddings must supply a cancellation notice in writing to "Petal and Pond Flowers Lakeside Company LLC." If the Client cancels the event, the retainer (Deposit) is non-refundable. If the Client cancels the event after the final balance has been paid, no refund will be issued.  
Funeral flower orders must supply a written cancellation notice within 48 hours, for a refund. 

  

We cannot be held responsible for failure to deliver any order due to an Act of God, crime, terrorism, denial of access to venues or extreme weather conditions. Flowers and Floral arrangements wilt and decay naturally over time. We are not responsible for any items purchased after delivery. 

 
Consumer Protection Law 
Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply. 

 

 
Limitation of Liability 
Petal and Pond Lakeside Flower Company LLC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site. 

 
Indemnity 
Except where prohibited by law, by using this Site you indemnify and hold harmless Petal and Pond Lakeside Flower Company LLC and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions. 

 
Applicable Law 
These Terms and Conditions are governed by the laws of the State of Missouri. 

 

 
Additional Terms 
FEES & RETAINER 
1. The Client agrees to pay Petal and Pond Lakeside Flower Company LLC a total fee of [agreed amount], as outlined in Proposal/Quote. 

1.2. A non-refundable retainer of [agreed amount] is required upon signing our contract to secure Petal and Pond Lakeside Flower Company LLC services for the event date. This retainer will be applied to the total balance. 
1.3. The remaining balance is due 30 days prior to the event date. 

1.4. Failure to make payments according to the agreed-upon schedule may result in the termination of this contract by Petal and Pond Lakeside Flower Company LLC, with no refund of the retainer or any other payments made. 

 

PAYMENT TERMS 
1. Acceptable payment methods include [Cash payments, personal bank checks, money orders, debit card payment, and credit card payment.]  

1.2. A late fee of $75.00 will be applied to any invoice not paid within 10 days of its agreed upon due date. 

 
EXCLUSIVE FLORIST 
1. The Client understands and agrees that "Petal and Pond Lakeside Flower Company LLC" will act as the sole and exclusive Florist for the event specified in this contract. 

1.2. By signing our contract, the Client agrees that no other person or company, professional or otherwise, shall provide fresh or artificial floral products for the event ceremony, reception, or any other event location specified in this contract without the express written consent of the Petal and Pond Lakeside Flower Company LLC. 

1.3 This clause is in place to ensure the integrity and exclusivity of Petal and Pond Lakeside Flower Company LLC designs, and to protect our reputation and brand from being associated with work that is not ours or does not meet our quality standards. 
 
FLORIST STYLE & DISCRETION 
1. The Client acknowledges that they have chosen the Petal and Pond Lakeside Flower Company LLC based on our unique artistic style and expertise.  

1.2. While the Client may communicate their preferences regarding floral types and arrangements, they agree that Petal and Pond Lakeside Flower Company LLC has the right to make final design decisions and to make necessary substitutions. 

 
FLORAL SUBSTITUTION & SIZING 
Flowers are natural products, and their availability, quality, and appearance may vary due to seasonality, weather, or supply chain issues.  

1.2. If specific flowers are unavailable or not of suitable quality, Petal and Pond Lakeside Flower Company LLC may substitute them with alternatives that are as similar as possible in color, style, and value, while maintaining the overall aesthetic of the design.  

1.3. The Client understands and agrees that while Petal and Pond Lakeside Flower Company LLC will make every effort to achieve the sizes and overall appearance discussed, natural variations in flower growth and form may result in slight differences from what is anticipated or shown in inspirational images.  

1.4. Petal and Pond Lakeside Flower Company LLC will make reasonable efforts to inform the Client of any necessary substitutions in advance, but the final decision regarding substitutions rests with the Petal and Pond Lakeside Flower Company LLC 
 
CHANGES TO PROPOSAL/QUOTE 
1. Amendments to the Proposal/Quote may be made up to 45 days before the date of the Event.  

1.2. Any such amendment must be agreed upon by both parties and evidenced in a writing signed by both parties and attached hereto.  

1.3. Changes requested within 30 days of the event may not be accommodated.  

1:4. Major changes (e.g., changing color scheme, changing centerpiece styles) may be subject to additional consultation fees and adjustments to the total cost. 

 
DELIVERY & SETUP 
1. Delivery and setup details, including dates, times, and locations, will all be outlined in the Proposal' Quote  

1.2. Any additional fees for delivery, setup, or teardown services will be detailed in the Proposal Quote. 

 
CANCELLATION & RESCHEDULING 
1. If the Client cancels the event, the retainer is non-refundable.  

1.2. If the Client cancels the event after the final balance has been paid, no refund will be issued.  

1.3. If the Client reschedules the event, a rescheduling fee of $300.00 and or 10% of the amount due may apply, and the floral prices may be adjusted based on current market value. 
 
RENTAL POLICY 
1. Petal and Pond Lakeside Flower Company LLC provides certain items on a rental basis, as outlined in the Proposal/Quote. These items include, but are not limited to, vases, containers, stands, arches, pedestals, and other decorative elements. 

1.2. All rental items are to be returned in the same condition as they were delivered to the Client, normal wear and tear excepted.  

1.3. The Client is responsible for any damage, loss, or theft of rental items from the time they are delivered until they are returned to Petal and Pond Lakeside Flower Company LLC.  

1.4. A detailed inventory of rental items will be provided to the Client, and the Client agrees to return them in their original condition within 10 days after the event. 
1.5. If rental items are not returned within the specified timeframe or are returned damaged, lost, or stolen, the Client will be responsible for the cost of replacement or repair. This cost will be assessed within 10 days of the return date and presented separate invoice, payable within 30 days.  

1.6. The replacement value of lost or damaged items will be determined by Petal and Pond Lakeside Flower Company LLC based on their age and condition at the time of the event. 
1.7. The Client acknowledges that they are responsible for ensuring the rental items are returned, or left in a specified location for pickup, if applicable, and for any labor associated with their delivery, setup, pickup, and cleanup. 
 
FORCE MAJEURE 
1. In the event of unforeseen circumstances beyond the control of either party, such as "Acts of God, pandemics, terrorist attacks, weather events, or venue refusing/denying entry. These or other events that make fulfilling this contract impossible, this contract may be terminated, and Petal and Pond Lakeside Flower Company LLC will not be held liable for any damages or losses. 
 

Respectful Behavior Policy 

1. Pond Lakeside Flower Company LLC is committed to treating all individuals with dignity, fairness, and respect to provide a safe and respectful business. We also expect the same treatment. We will not accept any mistreatment from any clients. In the form of verbal/physical abuse, discrimination, threats, bullying, harassment or violence.  Any mistreatments towards our staff, affiliated parties or other clients will result in the Clients contract being canceled, and no refunds given.  

 
 

CLIENT RESPONSIBILITIES 
1. The Client agrees to provide accurate and complete information to Petal and Pond Lakeside Flower Company LLC regarding any event details.  

1.2. The Client is responsible for any damage or loss of rental items provided by Petal and Pond Lakeside Flower Company LLC. 
 
Severability 
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid. 
 
Changes 
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
